iPhone & iPad Application

Welcome to PDF Converter, developed and operated by TechGear INC ("we," "our," or "us"). By downloading, installing, or using the PDF Converter app ("App") on your iPhone or iPad, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal Apple devices for personal or internal business purposes, subject to these Terms and the Apple App Store Terms of Service.

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the App.
  • Reverse engineer, decompile, or disassemble the App, except as permitted by law.
  • Use the App for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to gain unauthorized access to any systems or networks connected to the App.

2. User Content

You retain full ownership of all files and documents you process using the App. We do not claim any ownership rights over your content.

You are solely responsible for ensuring that any files you process through the App do not violate any laws, infringe on third-party intellectual property rights, or contain harmful or illegal content.

3. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including data obtained through third-party cloud service integrations (Google Drive, Dropbox, OneDrive). By using the App, you consent to the practices described in the Privacy Policy.

4. Analytics and Advertising

The App may use third-party analytics tools (such as Firebase Analytics) to collect anonymized usage data for the purpose of improving the App. This data does not personally identify you.

The App may display advertisements served by third-party ad networks. These networks may use anonymized data to serve relevant ads. We do not share your personal files or cloud service data with advertising networks.

5. Google Drive Integration

Google API Disclosure

The App allows you to connect your Google Drive account to import and export files. By using this feature:

  • You authorize us to access your Google Drive files and folders that you explicitly select for import or export.
  • We only request the minimum permissions (OAuth scopes) necessary for file browsing, reading, and writing.
  • Your Google Drive data is used solely to provide the App's file conversion and editing features.
  • You may revoke the App's access to your Google Drive at any time through the App's settings or your Google Account Permissions page.

6. Google API Services Compliance

Limited Use

Our use of Google API data complies with the Google API Services User Data Policy, including the Limited Use requirements. This means:

  • Google user data is used only to provide and improve the App's core functionality.
  • Google user data is not transferred to third parties for advertising or unrelated purposes.
  • Google user data is not used for serving ads or building advertising profiles.
  • Human access to Google user data is limited to security investigations, legal compliance, or with your explicit consent.

7. File Processing

Google API Disclosure

The App processes files (PDFs, images, Word documents, etc.) to provide conversion, editing, merging, splitting, compression, and other document management features.

  • Files are processed locally on your device whenever possible. Some operations may require temporary server-side processing.
  • Any files temporarily uploaded to our servers for processing are automatically deleted once the operation is complete.
  • We do not retain, analyze, or use the content of your files beyond performing the specific operation you requested.
  • Files imported from Google Drive, Dropbox, or OneDrive are treated with the same privacy protections as locally uploaded files.

8. Intellectual Property

All intellectual property rights in the App, including but not limited to the software, design, graphics, logos, and trademarks, are owned by TechGear INC or our licensors. Nothing in these Terms grants you any rights to our intellectual property, except the limited license described in Section 1.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

  • Your license to use the App is immediately revoked.
  • You should disconnect any linked cloud services and delete locally stored data if desired.
  • Provisions of these Terms that by their nature should survive termination (including limitations of liability, disclaimers, and intellectual property provisions) will continue to apply.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TECHGEAR INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Contra Costa County, California.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TechGear INC regarding your use of the App and supersede any prior agreements or understandings, whether written or oral. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
